These Terms and Conditions apply to all visitors (hereafter, Users) to the www.byebyebags.it website and to any interaction they make, whether to request a service (Customers) or to apply for partnerships with ByeByeBags (as Drivers or Partners). ByeByeBags may engage third parties to provide the services and/or act as a Manager. 

Browsing this page, or any interaction, implies understanding and acceptance of these Terms and Conditions. 

If you do not agree with them, please refrain from any browsing or interaction on the website. Should you proceed with browsing, any form of interaction shall be construed, for all legal purposes, as full acceptance of the Terms and Conditions. ByeByeBags reserves the right to change these Terms and Conditions at any time without notice and any changes will be posted on the website. Changes to the Terms and Conditions will not affect any Booking already confirmed.

ByeByeBags offers an innovative personalized luggage pickup and delivery service for travelers, designed to greatly enhance the travel experience and reduce the inconvenience associated with transporting and handling luggage before check in and after check out.

Regarding Drivers and Partners, the information provided is general in nature and all other information will be provided after the first interaction by ByeByeBags. If you find links on other sites that give you access to this page, please be advised that ByeByeBags has no responsibility, either for the origin of the page or the content posted on it. Therefore, we take no responsibility for ads and campaigns that use the ByeByeBags brand without being duly legitimized. As you browse this page you may find links to third-party platforms, including social networks (such as Instagram, Facebook, LinkedIn) or other web pages. The existence of such links does not imply that ByeByeBags has any right or control over the content of these web pages or materials. ByeByeBags is not responsible for the content of any of these platforms or any facts arising from their use or display. Therefore, it is the User's responsibility to make all necessary verifications before deciding whether or not to use them. No liability is accepted for any damage or loss resulting from their use. ByeByeBags is not responsible for any interference, interruptions, computer viruses, operating system malfunctions or disconnections that may temporarily prevent access to navigation or service delivery to Users. 

Obligations of users 

The User agrees to abide by these General Terms and Conditions, in particular: not to use false identities and to answer truthfully the questions asked in the interview phase; to provide personal data updated to the respective conditions, so that ByeByeBags can establish further contact. The User is responsible for the integrity of the data communicated to ByeByeBags and agrees to communicate any changes to it. 

Reservations 

Any User can book a baggage drop-off and pick-up service with ByeByeBags directly on the website by filling out the appropriate form. For customers arriving by air, please provide your flight number when booking the service. This will allow us to monitor any delays and make adjustments as necessary. For EU citizens, please book the pickup 30 minutes after the flight's scheduled arrival time. For non-EU citizens, please schedule pickup 90 minutes after the flight's scheduled arrival time. You must confirm the request with payment. By confirming your request for the service, you will become a ByeByeBags Customer. You are solely responsible for payment for all Services booked, and for all obligations under these Terms and Conditions, even if the Service was booked by someone else. In the case of same-day pickup, you may cancel a Reservation without charge within 30 minutes after Confirmation from the Reservation. If you wish to cancel a Reservation, please contact us immediately through our Channels. ByeByeBags may notify you that a Reservation has been cancelled at any time prior to pickup. You will not be charged for a Reservation cancelled by us and we will refund any payment you have already made using the same method used to pay for your Reservation. 

Become a Driver 

To become a ByeByeBags Driver, you must fill out the appropriate form directly on the website in the dedicated section and wait for further contact from the ByeByeBags team. The

To become a ByeByeBags Partner, you need to fill out the appropriate form directly on the website in the dedicated section and wait for further contact from the ByeByeBags team. The contractual conditions for becoming a Partner will be made available by ByeByeBags at a later date. 

Baggage pickup by ByeByeBags 

When you make a service request, you will be asked to indicate the date and time from which you would like your luggage picked up by ByeByeBags. Luggage must be of a size that corresponds to the service booked; it must be unopened and tightly packed. At the time of Booking Confirmation, you will be given a code for each piece of luggage being picked up. We ask that you place this code on each of your luggage so that the pick-up attendant can recognize it. Once we have picked up your luggage, you will receive an appropriate communication to the contacts you have given us. Until you collect your luggage, ByeByeBags assumes no liability with respect to your luggage and you will therefore be personally responsible for its safekeeping and delivery for collection in accordance with the General Conditions even where you decide to deposit your luggage in the custody of a third party, including the staff of your Accommodation. We will notify you if, at the time of pickup, our staff member has found any defects or obvious damage to your luggage. We will not be liable in any way for such damage. Factors such as traffic and weather conditions may prevent us from making the pickup according to the estimated time. If our pickup attendant is more than fifteen (15) minutes late and we have not notified you of the possibility of canceling your order, we will do our best to pick up your luggage as quickly as possible, including by contacting you to facilitate-where possible-a pickup at a different location specified by you, unless you caused the delay (such as, but without limitation, because you have directed us to the wrong Accommodation for pickup). We will attempt the pickup at the location you indicate to us when you make the Reservation. If you need to change your pickup location after you have made the Reservation, we may be able to change your pickup address only if the new address is in the same area as the one you originally indicated and our pickup agent is able to make the requested deviation from his or her pickup and delivery schedule. You will still be charged the full price of the Service if the missed pickup is your fault for any reason. Reasons for which you may be held solely responsible for a missed pickup include, but are not limited to, the circumstance in which you are not present at the location designated for pickup and/or your Lodging staff is not present/available for pickup and you do not answer the phone when the pickup attendant contacts you using the contact information you have provided to us or you answer but then are unable to allow pickup within 15 (fifteen) minutes. 

Baggage delivery by ByeByeBags 

When you make a request for the service, you will be asked to indicate the date and time at which you wish your luggage to be delivered by ByeByeBags. The deadline so stated is in favor of ByeByeBags as the custodian of your luggage. Factors such as traffic and weather conditions may prevent us from showing up for delivery at the time you indicate. In that case, we will notify you at the contact information you have provided and will make every effort to deliver your luggage to you 

as quickly as possible. Where this is not possible, we will ship your luggage at our own expense.

We will attempt delivery at the time and place indicated at the time of Reservation and will notify you when your luggage arrives at the agreed upon location. In total, we will wait a maximum of 15 (fifteen) minutes beyond the time indicated at the time of Reservation. In case of delay, please notify us at supporto@byebyebags.it in advance of the time indicated at the time of Reservation. If you will not be present at the notified delivery time, we will try to contact you. You may ask us to wait for you after the aforementioned 15 (fifteen) minutes, in which case ByeByeBags may at its discretion accept or deny your request. If so, we will wait for you for an additional 15 minutes, at a cost of 15 euros. The request may be made up to three times (for the maximum delay of 45 minutes and the maximum cost of 45 euros). Where you do not answer the phone when the delivery person contacts you and/or where you answer but then are unable to allow delivery within 15 (fifteen) minutes and/or where you do not contact us to ask us to wait for you or you contact us but we cannot comply with your request,

You will be notified of the storage location at which you will be able to pick up your luggage yourself upon payment of the storage fees. With the same communication, we will warn you that at that point you will be able to: request a new delivery, according to the availability of our employees, paying the price (in addition to the price already paid for the Service); request that your luggage be sent to you by mail at the address you will indicate; at the time of such request, you will have to pay ByeByeBags the shipping costs, in addition to a penalty of 50.00 (fifty) euros. If you do not choose either of the above options, or if the second delivery is also unsuccessful for reasons attributable to you, we may retain the storage of your luggage up to a maximum of 60 (sixty) days. After that time, ByeByeBags shall have the right to retain your luggage and sell it pursuant to Section 2756(3) of the Civil Code to satisfy its claim. 

Responsibility 

ByeByeBags acts as a mere custodian of your luggage and assumes no responsibility with respect to the property contained therein. Should we become aware that your luggage contains things from crime, we reserve the right to report the fact immediately to the appropriate authorities. It is strictly forbidden to keep in your luggage harmful and dangerous objects, weapons, explosive, easily inflammable or easily perishable goods or materials or exhaling foul odors or which may otherwise cause deterioration or damage to other luggage, live animals, even if enclosed in special containers. ByeByeBags will not be liable for damages. 

Applicable law and jurisdiction 

The General Conditions shall be governed by and construed in accordance with Italian law. Any claim or dispute arising directly or in connection with the General Conditions shall be submitted to the exclusive jurisdiction of the Court of Florence. If you are a resident or domiciled in Italy and you have made a Reservation for a use that may be considered unrelated to your professional activity, any claim or dispute arising directly or in connection with the General Conditions shall be devolved to the exclusive jurisdiction of the courts of your city of residence or domicile. Alternatively, as a consumer, you may file your complaint through the online dispute resolution platform (the "European ODR Platform," established by EU Regulation 524/2013).
